Hello
We purchased a house in 2019 by paying full amount and got registered.
At that time he told us i have loans that is why i am selling the house and said with advance amount i will clear loans and register.
We agreed and got registered on our name having some 50k due.
After few months a local person came and said we will lock the house the owner kept his original papers and took money from us, how can you buy the house? Till that time we didn't know that how seller kept the original papers with him and how they got them. After many days of argument we agreed with them to give 50k in exchange of the documents and exchanged.

Now after 2 years 2 people from a bank comes to house and say we came for loan recovery!! I mean what??

I called the seller and asked if he had taken any loan from the bank? He didn't tell us until i ask.
Bank people said in 2015 he mortgaged.
Took 6 lakhs loan and 3 lakhs due.

The reason bank came to recovery is he failed to pay EMI for last 3 months.

All the original papers with link documents are with the bank and area, house, house number are same except the Survey Number.
The documents we have registered has different Survey Number and the documents with bank have different Survey Number.
They have different Encumbrance certificate and we have different Encumbrance certificate.

The bank called the seller Infront of us and asked where is he? He said i got corona and i am in village.
The main thing is that he still says he live in our house to the bank while asked.

We are all tensed now the bank wants to seize the house if he doesn't pay.

He said on Monday i.e 28-06-2021 he will clear.

What should we do now?
We still don't know if he clears the due or not.
We don't know if he has taken any more loans on this property.

What is the solution for this?

A.Aap ko bhi property purchase karne se pahle uski sahi parkar sr janch kar leni chahiye thi. Yah aap ki duty thi. Kyon ki kanoon me ek sidhant hai kreta savdhan arthat kreta ki duty hai ki vah kisi bhi property ko purchase karne se pahle uske janch kare.
Ab rahi baat makan ki aap ne original sale deed liye bina kaise property purchase kar li. Aap ko vikreta se original sale deed lena chahiye tha.
Jo aap ke dawar nhi liya gya hai.
Vikreta ne aap ke sath cheat kiya hai isliye aap uske khilaf police me cheating ka report darj karaye.
Apne money ke liye money recovery suit file kare.
