Sir/Madam My grandfather have two sons my father and my uncle he has a piece of land which distributed to my father and uncle, my mother bought loans from bank which is around R.s 2 lakhs my mother paid most of loans but when loan amount R.s 65k is remaining my father sold the house to my uncle for the exchange of remaining loan amount i was 7-8 year at the time and mother was not informed it happened in 2003 or 2004 now do i have chance to get the land back

A.Dear Sir,
Your mother may file a suit seeking cancellation of such sale deed since it is your mother’s self-acquired property. Since your mother acquired the property by getting loan from others. You may fight for it.

A.Hi,
No one needs to give you permission if the property is in your father's name. Returning the property would be tough. You can, however, try to claim the land by claiming that the father's mental state is due to sickness or other circumstances.

A.Hi,
If the property was in the name of your father then no permission is required from anyone. It would be difficult to take the property back. You can, however, seek to claim the land by stating that the mental condition of the father is due to illness or other factors.

A.You will have to figure out that under what conditions and capacity did you father sell the house to your uncle. In case the transaction is legally valid, which it appears to be, then you cannot claim any right in the sold property. If the transaction is not valid then you can claim your right.
