One of our tenant of showing problem to subscribe their regular monthly maintenance charges and it remain to 2 yrs maintenance charges.Our apartment is not registered with society or owners association;as we just made our own apartment society take resolutions.Legaly what we can do for such tenant who are not participating any expenditure towards regular and reannovation charges as our building is approx 15 yrs old and need regular maintenance,common electricity charges and reannovation.Please guide.

A.You have to ask the registered Owner of that Flat who has given his flat on rent for payment of those charges because if his tenant is not paying those charges, then the Owner has the responsibility either to pay the same from his own or the Owner has to take necessary steps against that Tenant for noncompliance of the clauses of Rent Agreement.

A.Hi,
If there was such a clause in the agreement which makes the tenant mandated to pay for it, you can move legally in case of a breach. You can also ask for compensation for your losses.

A.Hi,
If there was such an agreement between you and the tenant, he is obliged to comply with it. Any contradiction to any of the provisions leads to a breach of contract and can be prosecuted.
