I own a flat in my name. It was completely bought by my savings and bank loan. I wish to write a registered will to my non-blood relative (say Aunt). After my death will my property go to my legal heirs (like Father, Brother, Wife) or will it go to my non-blood relative (say Aunt) as per my wish i.e. registered will. Please advise. Thanks in advance.

A.Hi,
According to the Indian Succession Act of 1925, anybody who is of sound mind and is not a minor can create a will; if a will is formed in a person's name, the property is passed to the person specified in the will and no one else after the person's death. However, it is critical to execute your will such that your legal successors cannot argue that the will was created under duress or compulsion.

A.Hi,
According to the Indian Succession Act of 1925, anyone who is of sound mind and who is not a minor can make a will, if a will is made in the name of a person then after teh death the property is transferred to the person named in the will and no one else. However, it is imp to execute the will so that your legal heirs cannot claim the will was made by coercion or force.

A.After your death until and unless that Will is duly probated from the competent Court of Law,it remains inoperative. At the time of that probate application,notices are to be given to your nearest blood relatives who will get your assets if there is no Will.
