Hi, Am currently in Australia and need to file for a divorce. Partner is in India. But looking at the current situation and lockdowns it’s highly unlikely for me to keep appearing for court notices. Can you please suggest how will this be possible when the applicant is overseas

A.Dear Sir,
If you are Abroad you can execute a special power of attorney in favour of your blood relative or any other person in India to appear on your behalf and if required your video conference will be taken to close the case.

A.It is necessary to know whether you are going to file contested Divorce or you and your spouse are going to file mutual consent Divorce because the processes are different. It is also pertinent to mention that atleast one year separation between the spouses is must for filing Divorce in India.

A.Dear client,
Yes, you can opt for online divorce by filing online divorce form but the divorce should be on mutual consent of both the partners. After filling the form you will get the email under 48 hours which will contain the information about further procedures.
