A person married again after the death of 1st wife. From first wife he has one son & one daughter. From second wife there is only one daughter. He has purchased one flat jointly with second wife. All children are married. Now second wife also died. What are the rights of second wife 's daughter in both ancestral properties as well as in the flat in the name of her mother and father.

A.Dear client,
The children of first wife and second wife in this case has same right over their father's property. They are considered under the legal heirs as per section 16 of Hindu Marriage Act.

A.Dear Sir,
All the children are entitled for equal share and living wife is not entitled for one share since he married after the death of his first wife.
