Sell of a multiple co-owned property in which one co-owner disagrees
2 years ago
We have a joint property (6 cottah land with 4 storied building). Me and my 3 uncles are co-owners with 25% share each. Now 3 of the co-owners including myself want to sell the property. However, one of my uncle does not want to and won't provide his consent. How can the other 3 co-owners sell their shares?
A.Dear Client,
You can file a partition suit before the concerned civil court and after the property is partitioned you can sell the property without anyone's consent.
Thank you

A.Dear Client
you need to go for partition and demarcate his share so that you can sell rest of the property/ land without the consent of the person who is not interested to sell. Alternatively you can leave the share equal to his and sell rest of the land and building.
