A.Dear Madam,

Your husband's case is very weak. You can engage a competent family advocate and see that his divorce petition is dismissed as not maintainable. Such divorce case cannot be filed with in 01 year of marriage.

A.Dear client,
Your past life or even your engagement has nothing to do in your present divorce case filed by your husband .I dont think it will be easy for your husband to get divorce unless and until you yourself is willing.
Regarding alimony or staying with your husband its your choice.

A.First of all ma'am, one can file divorce only after completing the period of one year from the date of their marriage except on any emergency ground one may file divorce by taking leave from the learned court of District Judge. Are you sure that your husband has filed a suit for divorce?? or is he filed a suit for annulment of marriage?? You should immediately contact an advocate for fast relief to your problems. You may also file a suit for restitution of conjugal rights so that you can again start living a happy marital life with your husband upon the order of the court. You may also file a police case against him if your husband have taken any kind of dowry from you or your parents and the time of your marriage. You may also file a maintenance case against your husband for providing you monthly maintenance for your daily survival since you are unemployed. You have several remedies to your problem therefore you need to consult with an advocate at earliest to gain and claim your legal rights.

A.Dear Client,

As per the facts which have provided, your husband may file for divorce without mutual consent under Section 13(1) of the Hindu Marriage Act and if he proves in the Court that you were having an extra marital affair then your chances of getting alimony is quite low.

Hope this clarifies your doubt and requirement.

Thank you.
