illegal construction on a land which is in court case.

we have won a case against our grandfather. we are waiting for preliminary decree from court to send a commissioner to partition our lands into 4 parts. my grandfather was managed to register his part lo the land which is in court case. the person who bought the land has occupied extra land and started construction. we sent him notice and showed paper add submitted by lawyer. the person who bought the land claiming my grandfather cheated him by selling land which is in a court case. but in reality he knows the land was in court case, he decided to illegally obtain extra land from our parts of that land. he behaves like rowdy. any solution for this?

You may immediately file application before executing court to stop such illegal construction. Before that you have to implead such person as a party to the execution proceedings.

A.To give opinion, it is necessary to know whether at the time of filing of that Partition Suit, any Stay Order or status quo Order was taken on your behalf and is there any restrictive order upon your Grandfather for neither disposing of nor to change the nature and character of that property.
