I'm from Haryana, my mother is giving all agricultural property ( approx. 3 acres) to her 2 daughters without giving anything to her 2 sons.

My father died many years ago and gave the majority share to my mother, my mother never lived with sons, daughters took care of her and we tried to bring her into our home but my sisters forced a lot.

Now they want mother to give all land to them (daughters)

Any solution???

1. Can I file a case against my mother that how she can remove her sons from that property.

2. Can I file a case on my sisters to stop them from acquiring land or not just stop them to earn from that land for the future as now their Lalach came.

3. Anyway to hold that land so that no one can use that agricultural land further. (I did farming on that land for more than 15 yrs).

A.Dear Sir,
My answers are as follows:

1. Can I file a case against my mother that how she can remove her sons from that property.
Ans: If your father given such land to your mother exclusively then only she can give such property to her daughter without the consent of sons.

2. Can I file a case on my sisters to stop them from acquiring land or not just stop them to earn from that land for the future as now their Lalach came.
Ans: It all depends nature of land in the hands of your mother.

3. Anyway to hold that land so that no one can use that agricultural land further. (I did farming on that land for more than 15 yrs).
Ans: You may take injunction order from the Court and restrain others from dispossessing you.

A.Dear Client,

If your mother is willingly without any external pressure or undue influence giving her share of the property to her daughters then you can’t do anything about it. Till she’s alive you don’t have any right over the property anyway.

A.Yes you can file a suit for partition since after your father's death, your mother, all your brothers and sisters are the legal heirs of your deceased father. Hence all the properties inherited by your father as well as bought by your father shall be divided between all of you equally and legally. If any problem arises, then the victim can file a case against the wrongdoers.
