Need signature from uncle for house loan

The loan company asks us to get sign from my uncle for approving loan. This house land was bought by my Dad in my grand fathers name. Then my grand father gifted to my Dad. Do my brothers and I need to get sign from my dad's brother too. He ran away from family 20 years ago. All taxes and property related expenses are in my mother's name and my dad passed away years ago. Please guide me. Thanks

You have to satisfy the conditions of the Bankers and if you are not comfortable or unable to satisfy their conditions then you may go to another Bank. Normally, since it is standing in the name of your mother and which was acquired by your deceased father by way of gift as such NOC from yourself and your brother are necessary but not that of your uncle.

A.If your grandfather had made registered Gift Deed in your Dad's favour, then your father became the absolute owner of that property and as that property was not ancestral but self acquired so your uncle's signature is not needed . If your grandmother predeceased your father, then after your father's death without making and publishing any Will, his property has been devolved upon his wife and children each having undivided equal share therein so it is necessary to have Legal Heir Declaration in this regard.
