I bought first floor in a builder flat in uttam nagar , Delhi. Now the top floor person is putting lock on the roof saying that he has roof rights. Water tanks of all the floor are place at roof. My question is that can he put lock on the roof gate, and everytime when I go to check my water tank I need to notify him and take key from him. Plz refer below for what is mentioned in the flat registry about the roof and advise. I need to change the tank from 500 Ltr to 1000 Ltr. Can't I change the tank size. what should i do. Please advise.

A.Dear Sir,

Normally roof belongs nobody and it can be used commonly. Please check the clauses of the sale deed and accordingly get duplicate key for the said lock and use the terrace.

A.Dear Client
Usually the roof area is considered as common area accessible to all and no one person can have the rights on the roof. You need to find out whether the builder has sold the roof separately to that owner or not. If no then you have the right to go there and he cannot keep it under the lock.

A.Dear client,
commonly, roof can not be considered as in the owner ship of a specified person. it would have mentioned in the sale agreement or in the terms and conditions. please check them once.

A.Roof is usually kept under the common area of the multi-storied building so to give opinion, it is necessary to scrutinize your registered Purchase Deed for the terms and conditions specified therein in this context.
