Want to know about the Sec 9 and DV sec 12 act and Section 125 in The Code Of Criminal Procedure
My wife has filed case against my divorce case which is sec 9 and dv act sec 12 and section 125. I want to know will I have any advantage over these 3 cases as the cases which my wife has filed against me are completely different on one side she is saying I want to go to husband house and on other side she is saying DV has been happened against her at my home and also she is demanding the allowance on false grounds. Will I have any advantage against her in my divorce case as dv act and section 125 together and other hand she is saying she want to stay with me. Please let me know.

When you have filed a case for divorce then your wife has filed a case of Restitution of Conjugal Rights under Section 9 of Hindu Marriage Act. She has also filed a case of domestic violence under Section 12 of the DV Act for getting back to her matrimonial house. Section 125 of CrPC case has been filed for getting maintenance from you (husband). All the above three cases are strongly in favour of her and you need to carefully with your divorce case.
