Sir, i bought a house in feb 2018 which has electricity bill dues. Bill amount 4.5 lakhs. The seller tricked me by showing latest paid electric bills. The seller had three connections at same house and last and the latest meter bill was paid but the giant dues were with other two meters. Sir i am a simple man, can't afford such amount as i am already loan and debt loaded. Please guide how can i make him pay all his dues. And secondly please let me know if i have to pay all dues now.
In registry there was a line " PROPERTY IS FREE FROM ALL DUES, TAXES AND MORTGAGE". Still he does this. Please guide me sir.

A.U can initiate both civil and criminal action against the seller. If it is mentioned in sale deed that all dues and taxes are already paid and yet seller has actually not paid, it amounts to cheating. In this situation get an FIR registered against seller u/s 420 IPC.besides this u can also file a suit for damages on the ground of misrepresentation.

A.You can sue the legal heirs who have shared the proceeds of the sale,better to contact a property lawyer from Vidhikarya for taking up the issue quickly & protect your interest.

A.Give a legal notice to your seller for discharging his dues. If he doesn't lodge complaint with the local police station against him for criminal breach of trust and cheating. Parallely you can file a civil suit for recovery of the dues. Contact a local lawyer from Vidhikarya

A.You are responsible to pay for the Electricity bills dues even if remained unpaid,better to contact a Lawyer from the Panel to issue a legsl notice on all aspects of the issue to the seller quickly & protect your interest.

A.See when we make a deed we do mention that the property is free from any dues and if anything is due then that has to be paid by the seller unless the buyer agrees to pay. This is a case of breach of agreement and falsegood. So ask the seller to pay the dues or else you will be going the legal way. If he doesnot pay heed to you then first send him a legal notice followed by a civil suit.

as per civil law the son and legal heirs are liable to pay to the extent he received benefits from his deceased father. It is obligation to pay the debt out of the estate of the deceased and not out of personal assets of the son and legal heir. This obligation is on only hindu son and not on every son (so muslim son is not bound). There is no criminal liability of a son against any act done by his father. Only civil case maintainable.

A.You have only one option, that is filing a cheating case and another recovery case against your seller. If you do not pay up to the department, they will disconnect power connection and you cannot prevent it.
