My friend have 5 years separation and she filed the case 3 years back counseling is going on she don't want to stay with here husband . But husband is not giving divorce. she have a 5 year old kid also. she already give the she don't need any compensation also she is educated and want to quit from the present conditional nd pressure of the life ..Please can help me how to get divorce what are the possibility.
A.Dear client, i am sorry to hear that. Bilut in this case you can go for mutual concent divorce. If not then you can file divorce for Irretrievable Breakdown of Marriage

A.Your friend can apply for mutual consent divorce which is a better option with a MOU between both wrt the child custody and visiting rights etc.

A.Kindly file a contested divorce suit before the family court of her local jurisdiction along with a suit for claiming custody of their minor son by stating all the allegations against her husband. She needs to consult with an advocate for proper legal guidance.

A.There should be sufficient causes for taking divorce or living separately in married lives. If your friend has it, she can file petition for divorce against her husband with clear terms as to the custody of kid and that she doesn't want anything or want such and such... whatever. They can mutually too go for divorce once they are ready and willing to do so.
