I have recently bought a ready-to-move-in flat from a builder in Howrah, kolkata. Upon registering the sale deed, i got to know that the builder has already sold the flat(in form of registered sale agreement) to another buyer who has taken loan from bank on the now discussed property. Upon confrontation with the builder, it came out that the first buyer is ready to clear the loan and cancel the registered sale agreement but my registry has happened before the first buyer cancelled his agreement.

Will i be still the rightful owner of the property or do i need to cancel my sale deed and do the registry again. In case i have to cancel the sale deed, would i be eligible for stamp duty and registration charges refund

A.Dear Client, has the first buyer now cleared off the loans? Also, what's the take of the builder now? I would suggest you to properly talk to an advocate and brief them the facts, before taking decisions. Thanks
