I have been married for 12 years. From this marriage there are two daughters of 11 years and 7 years respectively. My husband deceived me. He has puberty and physical relations with other women before marriage and even after marriage. We have a difference of opinion regarding this matter. Secondly he does not fulfill our responsibility. My father meets all our expenses - house rent, children's fees, books, uniforms, food items A to Z. He has been living separately from me for five years. It is learned that nowadays he is celebrating colors with new girls. He never contacted us in these five years. So I talked to him about taking Khula and keeping the custody of my children with me, he has agreed to it. I want to keep my daughters away from the shadow of this characterless person.
I want to know from you that what will be the cost of making Khulnama.
Your husband may not agree for Khulnama so easily. Better you file maintenance case, domestic violence case and made him to agree for your terms.
The Muslim Personal Law does allow a married Muslim woman to seek divorce (Talak) through "Khula" which is kind of mutual consent divorce. You need to speak to your husband and if he is ready then you need to get in touch with a lawyer for preparation of khulnama.
