we are three brothers including me .our grand father had a land worth 1500sq yards ,30 yrs back he died .Till now,we have not made partitions among us.But my younger brother without any notice to us ,he with the help of my father .got transfered 200sq yards .my father also died 3 yrs back.how can my brother got transfered some property without any parition and without consent of my elder brother and me .As the property was my ancestral property.

It is advised that you file a criminal complaint against your younger brother right away for fraudulently registering 200 square yards out of 1500 square yards, which is still an undivided Hindu property, without first obtaining the agreement of other co-owners. You should also submit an application for a succession certificate right away, followed by one for a correct division. Please contact an advocate specialised in property disputes.

A.Hello Client,

You are suggested to immediately file a criminal complaint case against your younger brother for having falsely registered 200 sq yards out of 1500sq yards which is still an undivided Hindu property without having the prior consent of other coparceners for the same. Moreover, you should immediately apply for a succession certificate and then for proper partition.

Same thing i was doing mam,i approached a lawyer and willing to send notice to my brother's over the partition issue.but my lawyer charging 20,000 as court fee as per the property rate 5000rps per sq yard over 1000sq yards .And again he asking money for challans and his advocate fee as 20,000 totally he estimated amount 50,000 is charging even before he sending notice to them.when i ask him what about notice,whether he sent or not.he is saying it will take time even 1week finished still he saying it will take time.

A.Hi client,
Please confirm that who's portion is being transferred to your brother. If your father has willfully transferred his share to your brother then you cant help it.
Please contact an advocate who expertise in civil matters.

Ancestral property cannot be transferred, by my father to my younger brother without coparceners consent.

If its an ancestral one then he cant but his share after receiving in his name he can always transfer. But such receiving does not apply here, as you said its an ancestral,undivided property. In that file a complain against them.
