We have built a house(me, elder brother,father) 6 yrs ago. The house belongs to my mother's name.My brother paying the property tax and electricity bill(electricity bill comes on my brother's name) since 6yrs. Can my brother or father claim the property? If my mother wants to sell the property is there any legal obstructions?

A.Dear client mother have full access and right to sell her property.no one can oppose her.

A.Dear Client,
All the people( you, your brother,father) who have invested the money will get their share equally.
Do you have any proof of your contribution?
How did you pay, mode of payment?
The other part is Billing. How did you get the Bills? Whose name?For example Cement,Steel,Sand,Bricks,marble,PH.D work,Electrification etc.
After getting the information, I may be in a position to say.

Sir you know how it happens in village area. There are no bills of construction material. About the contributions, I have a home loan running on the same property. I have taken personal loan as well during the construction period. My brother in law's have given some amount to my account for construction. My father has withdrawn amounts from LIC, personal loan and other modes. All transactions we can get in passbook But all material and labour transaction happened in cash mode.

My concern is as my brother is paying property tax since 6yrs, since he staying in the house. Can he create any problem while selling?

Dear Client,
The building must have constructed in a piece of land.Who is the owner of the land? Whose name is written in ROR? Whose name Receipt is given ?Earlier you had said Brother now you are saying Brother-in-Law. There are two different persons in Law and also in relationship .I presume you are not staying in that piece of land. Provide the complete information in one lot not by installment in order to get the correct answer.

Sir, sorry for the confusing statements.
Below the complete information.


Land owner(ROR): my mother
House owner(ROR) :my mother
Land bought : Brother and Father has given money. Again no proof available.
House built: Money contributed by - Me, Father, Brother,Two brother in law's

I did not understand about receipt part in above reply by you. If it's house tax receipt, brother is paying every year. I am not sure whose name receipt is given. I assume who ever pays receipt will be on owner's name.

Dear Client,
Mother can sell the property/ donate the property/ will the property without consulting you.
You may not have problem during your life time but problem may arise among the children of next generation which your children and the children of your brother and brother in law.
So, it will be advisable to sort it out through a Local Advocate or Advocate of Vidhikarya.com who can arrange a good lawyer for you.

Thank you sir for the advice. Just one more information I require. If all the property papers I give to my Father or Brother. Will that impact my mothers ownership on the house by any means?

A.Your brother or father cannot claim the property as all of you put the property in the name of your mother and she has legal title over the property and she can sell the property without other`s objection as she got title over the property. They have no share in it.

A.There is no legal objection to sell your mother`s property by your mother as the title deed of the house is in the name of your mother.
