Two brothers gave builder construction of there plot. After construction top floor was sold to a third person with 1/4 undivided share in stilt parking by the builder/ owners 2 year back.

We purchased a floor from brothers a year back with 1/4 undivided share in stilt parking.
Last month we purchased another floor from 1 of the brother in which front gate parking was registered in maps to us. Also parking was registered between both the brothers after there internal dispute settlement 6 months back.

Now the third floor owner is disputing front gate parking with us stating your registry parking is invalid in front as shown in registered map as his registration of deed took place 2 years back which shows 1/4 undivided share in parking and all of the rest 3 floor registry for sale to me or settlement between brothers (original owner of plot) took place later and hence invalid

A.Hello Sir,
Undivided Share of Land is the share of land owned by you when you purchase the property. Basically when you buy a flat or apartment, you are buying two things :
1. The constructed building – where you actually reside
2. The proportionate share on the land, where the whole property is built.
For example : If there is land measuring 1,000 sq and there are 10 flats or equal size is constructed on that land, then each owner will have 10% of the land as his/her share.
So maybe you both are having the shares in the parking. You can ask the previous owners to make it clear.
