I want to buy property whoes current owner is GPA (Registered) holder and previous owner is REGISTRY holder. Can the ownership will transfer through REGISTRY in my name. Floor 80 gaz

But sir, as per power of attorney which is Registered with sub registrar, GPA holder have rights to sell the property on behalf of previous owner( which made REGISTRY).
My question is that if he has power to sell and work as a agent between me and the 1st owner.

A.NO Transfer of property on GPA, better to contact a Local Lawyer from the panel for all matters of the issues quickly.

Sir, I will make REGISTRY in my name, as current owner has power to do sell. As per power of attorney which is Registered at sub registrar. This will be right????

Hon'ble Supreme Court has laid down Rules and Tranfer of Property on GPA has been not a valid,in case of disputes or issues you cannot take protection under the Land Mark decision & rules laid down by the Apex Court.

Okay understood sir, now what is the solution. If the previous party is not reachable. And I have already made partially payment based on the GPA document.

A.But at the time of registration property owners must be present for registration

But sir, as per the power of attorney law, GPA holder can sell the property on behalf of previous owner. Because previous owner gave power to current GPA holder and did Registered at sub registrar.

Still original property owner must be present.

According to the supreme court judgment . POA holder cannot sell his property. I told you at least owner should be present at the time of registration. Without real owner cannot possibly to transfer property
