I got Married in 2014
I have 7yrs girl
From 3rd month of marriage, spouse wanted me to leave the house without divorce which led mental torture and physical abuse..
Causing me depression.. i am living separately from past 2 yrs...
Please advise if Divorce can be finalized by court as my spouse is not cooperating for mutual divorce....

Under the Hindu Marriage Act (HMA), 1955, the husband and the wife have been given the option to file for a mutual consent divorce. However, if your spouse is not agreeing to mutual consent divorce, you may file a divorce petition on the ground of cruelty provided under Section 13(1) of the Hindu Marriage Act, 1955.
You can also ask for maintenance charges from the husband
