How to challenge will How to challenge will

My father filed a case against his brother concerning our grandparents' property. Unfortunately, both my Grandpa and Grandma have passed away. During their lifetime, my uncle created a will in his favour, but we have no information about its contents. After my Grandma's passing, my father promptly registered a case, and we discovered the existence of the will. However, it has been two years, and we have not yet been granted any rights to the property.

The property includes some commercial spaces from which my uncle is receiving rental income, while we are being denied any benefits. We are wondering if there is a way to halt the shop rent or submit it in court.

As the recent unfortunate events have taken place, with the loss of my father, I am now responsible for managing this case and handling the upcoming hearings. I seek advice and suggestions on how to proceed in this matter.

A.Dear client,

Engage a Lawyer: If you haven't already, engage a competent lawyer who has experience in property disputes and inheritance matters. They can help you understand the legal process, represent your interests in court, and advise you on the best course of action.

Obtain a Copy of the Will: As your uncle created a will in his favor, it is crucial to obtain a copy of the will to understand its contents and how it affects the distribution of the property. Your lawyer can help you with this process, including requesting the court to produce a copy of the will if it's already in possession of the court.

Seek Information on Pending Case: Request information from your lawyer regarding the current status of the case filed by your father against your uncle concerning the property. Understand why there have been delays in resolving the matter and inquire about the next steps.

Submit Rental Income Information: If your uncle is receiving rental income from the commercial spaces on the disputed property, inform your lawyer about this. They can explore legal options to halt or redirect the rental income until the case is resolved.

Continued Pursuit of the Case: Property disputes can take time to resolve, especially if there are legal complexities involved. Continue to actively participate in the case's proceedings, attend hearings, and cooperate with your lawyer to move the case forward.

Consider Mediation or Negotiation: Depending on the circumstances and the willingness of both parties, you may explore the possibility of mediation or negotiation to reach a settlement outside of court. This can sometimes lead to a faster resolution and may help preserve family relationships.

Ensure Legal Representation: As you are now responsible for managing the case following the unfortunate loss of your father, make sure you have proper authorization and legal representation. Work closely with your lawyer to understand your rights and responsibilities in the legal proceedings.
