Hi sir this issue is regarding property settlement , my grandmother had earned own property by working hard not having single rupee from his husband , hence her is own property not her ancestral or her husband ,,recently my grandmother expired she wrote will once but changed again writing another last will 2 months before expired , as per will my brother does not have anything , grandmother wrote all her property to me Nd my sister , but my brother is not accepting final will instead staying at my home and asking for property wat is procedure for making him to vacate my property

A.Dear Client,
On receipt of a letter of administration from the Civil Court by filing suit for probate of the latest Will of your grandmother by the executor of the Will, you can take legal action for unauthorized occupation against your brother for evicting him from the property title of which is transferred to you through the probate of the Will. A.Dear client,
Follow the below mentioned process-
Stage I - Send a Notice to the Tenant to Vacate: An eviction notice needs to be filed in a court under the appropriate jurisdiction mentioning the reason for eviction and the time and date by which he has to vacate the property and is then sent to him to vacate the rental property. Youmust give a reasonable time to him to vacate the rented property.

Stage II - File an Eviction Suit: Your brother may refuse to vacate the property after receiving the court’s eviction notice and contest the eviction. In this case, you can hire a rental property lawyer to file an eviction suit against him. The suit is filed in a civil court under whose jurisdiction the rented property is situated.

Stage III - Final Eviction Notice: The court hears both sides and issues a final legal notice for eviction based on the arguments and evidence present. Your brother has to vacate the rented property once the court sends the final eviction notice.
