Hi

We are 3 siblings. Our father has an ancestral property in Goa in his name. He passed away 2 years back. I want to sell the property and have found a buyer. My 2 siblings want to keep the property.

I have asked them both to buy me out at 1/3 the price of what the buyer is offering.

What kind of documentation is required for this? Can I execute a release deed for this property along with a POA (for them to get the succession deed) or do we need to get the succession deed first ( get the property in our names) and then execute a release deed (my 1/3 share in 50% ratio to each of them)

A.Dear client,
A relinquishment deed must be in writing, and the deed must be registered. By “section seventeen of the Registration Act, 1908,” relinquishment deeds must be registered at the relevant sub-registrar office. Legal Rights should be claimed in the deed.
