Dear Sir, 8 mnths back my wife has bought a2bhk flat in karanjade frm Dubey builder. Taken Ra. 2.5 lacs cash for parking and after possession given an allotment letter but after a month we got to know that the parking was already alloted to some other flat owner 2-3 years back. When we confronted the builder gave another parking besides that very parking he gave earlier. But this parking is in front of the entrance stairs. He is saying this approved parking however society people are asking not to park there as the entrance will be blocked. However there is a ramp also to enter the building. Builder is saying he can't return the money as it as per the promise and the parking area is valid and approved in his building blue print. What to do now? Please note can we take any action keeping that my wife, a woman is the flat owner who hails from OBC. PLEASE HELP & SUGGEST. Thanks

A.Dear client,
According to the Supreme Court, an apartment lacking a parking space cannot be registered and is therefore incomplete. You are entitled to the return of the advance payment made by your wife on that basis.

A.Hi client,
Immediately send the owner a legal notice through an advocate. Explain the entire matter to the other people of the society, ask them to tell the matter to the builder too.
If no response is received approach the consumer forum.

A.Dear Sir,
The Hon’ble Supreme Court says any flat without parking place cannot be registered and incomplete. On that ground you may claim return of the advance amount paid by your wife.
