My divorce case is going on currently, but I don’t want divorce but my husband needs divorce and giving false allegations and even judge also noticing his actions and dramas and he is giving chances to him to think about me and my daughter but he is not giving proper reasons that why he need divorce like that and judge is telling him just think twice about the child and your life and he gave other chance. So my question is if judge is rejected our divorce petition and what is the next step? Should my husband take me and our daughter to his home and live? If yes that would be happy? Could you please let me help with this point? He must take us with him if divorce got rejected??

A.Dear client,
If you have provoked to file the divorce petition, you can withdraw it without your spouse's agreement. You must ask the court clerk if your partner has filed any answer or not. If not, you can file the document to dismiss the petition yourself. The court will grant your dismissal automatically.

But if your partner has responded to the petition and filed a counterclaim, you cannot withdraw the petition without their agreement. The court can allow you to dismiss if they have filed an answer without a counterclaim.
