Can I reclaim right in sold ancestral property of my grandfather after 20 years if my Father was threatened and blackmailed at that time .He was mentally unstable at that time and he was blackmailed on the account of kidnapping of his family.

If the property is ancestral in nature, then the grandson or granddaughter has an equal right as his father in his or her grandfather's property. A grandson or granddaughter has a right to inherit his grandfather's property since birth. The time limit to claim ancestral property is around 12 years. However, the court may accept and process your request if there is a valid reason for delaying the claim. If you want to file a civil suit to restrict the sale of your ancestral property, as per the Limitation Act, the same must be done within three years of the sale period.
