A.Dear Client,
Engaging in a consensual sexual relationship with a married man does not typically expose the involved parties to criminal liability. Under the adultery law in India (Section 497 of the Indian Penal Code, until overturned by the Supreme Court in 2018), it was a criminal offense for a man to have consensual sexual intercourse with a married woman, without the consent of her husband. However, no party was criminally punished in case of adultery between a married man and an unmarried woman. Under Section 417 of the Indian Penal Code (IPC), cheating is defined as a dishonest or fraudulent act with the intent to deceive or injure another person. In this case, the married man's failure to disclose his marital status to the unmarried woman before engaging in a sexual relationship with her constitutes cheating. Additionally, the unmarried woman can file a civil suit against the married man for damages. She can seek compensation for the emotional distress and mental anguish she has suffered as a result of his deception.
