Why is my husband filing income tax in my name without my permission?
How can I stop my husband from filing income tax in my name without my permission?
we're not in speaking terms for past 1year3months and i am trying for divorce

A.Dear Client,
​​​​​​​​​​​​Return Form ITR - 1 (SAHAJ) can be used by an individual whose total income includes: (1) Income from salary/pension; or (2) Income from one house property (excluding cases where loss is brought forward from previous years); or (3) Income from other sources (excluding winnings from lottery and income from race horses, income taxable under section 115BBDA or Income of the nature referred to in section 115BBE). Further, in a case where the income of another person like spouse, minor child, etc., is to be clubbed with the income of the taxpayer, this return form can be used only when such income falls in any of the above categories. ​​​​​​​Form ITR–2 can be used by an individual and Hindu Undivided Family who is not eligible to file ​​ITR-1 Sahaj​ and does not have income from “profit and gains of business or profession” and also no income from “Profits and gains of business or profession” in the nature of interest, salary, bonus, commission or remuneration, by whatever name called, due to, or received by him from a partnership firm. Further, in case the income of another person like spouse, minor child, etc., is to be clubbed with the income of the taxpayer, this Return Form can be used if the income to be clubbed falls in any of the above categories. So, clubbing the income of both spouses/assessees, either spouse can file an ITR online. In the Online mode of filing of ITR, verification of Return is done through the AADHAR-based OTP of the Assessee that does not require a signature of the Assessee. If you want to file your own return yourself, inform your spouse in writing accordingly, failing which, you may bring the matter to the concerned ITO for doing the needful in the matter.

If it's safe to do so, consider communicating with your husband about your concerns. If you're uncomfortable with him filing taxes on your behalf, make it clear that you do not give permission for such actions. Ensure that your personal information, including your mailing address, is accurate and up-to-date with the tax authorities. This may reduce the risk of your husband filing taxes on your behalf without your knowledge. If you believe there is identity theft or fraudulent activity, you may want to report the situation to the appropriate tax authorities.

If you have not signed it is not binding on you. Change all pass words so that he cannot have access to your email and other online accounts.
