Maintenance charges

I have purchased a flat in suburbs,total flat is 6. Septic tank has to be cleaned regularly. Two owners have not occupied the flat and refuse to share the charges. I want to know whether septic tank cleaning comes under maintenance charges or not. And does occupancy determine the maintenance charges. Society has not been formed.

A.Sir firstly,
YES, such cleaning of the septic tank shall fall under the head maintenance charges as theses are common to all and everyone who is a part of the society shall avail the facilities provided by such tank. Further more cleaning of the tank is not done for the benefit of any single occupant, it is done so that everyone who is a part of such society gets clean water which is essential.
Secondly, you must form a society for the convenience of oneself and others.

A.Dear Sir,
It is better to form Society to accrue benefits in the name of Society failing which you cannot enforce the relevant rules. Anyway such act comes under the definition of maintenance charge and all the flat owners suppose to share the expenses.
