A.Dear Client,
To address the situation where your brother is hindering the transfer of possession to the purchaser of the land you sold, you may need to take legal steps. First, ensure that you have all the relevant documentation related to the land sale and the division of shares through podi in 2015. If there is a formal deed or agreement specifying the terms of the division and your brother's agreement to the arrangement, it can be valuable.
You might want to engage with your brother in an attempt to resolve the matter amicably, explaining the agreed-upon terms and the necessity of allowing the purchaser to take possession. If this does not yield results, consider seeking legal advice. Consult with a lawyer to review the documents, understand your legal rights, and explore options for enforcing the terms of the division. This could involve sending a legal notice to your brother, emphasizing the consequences of non-compliance.
In parallel, ensure that the purchaser of your land is kept informed about the situation and any legal steps you are taking. If needed, the buyer might also need to seek legal recourse to secure possession. Legal actions might include filing a suit for specific performance or seeking injunctive relief to enforce the terms of the sale agreement. Legal guidance tailored to your specific situation is crucial for a satisfactory resolution.
Thankyou
