Me and my wife separated 2 years she is staying in her home. She blocked all access to my kid. My father is more than 70 years. So I want to show my son to my dad but she not accepting so can I take my son for 3 days to show to my father and then return to my wife. Whether she can file any case on me. Child is 3.5 years old and marriage as per special marriage act.if something happens to my dad I cannot live with the guilty. Please give advice. By any way I need to show my son to my dad

A.Dear Client,

Meanwhile, you can initiate a Permanent Child Custody case and obtain an injunction order within the same case. This injunction order will restrain the wife from permanently taking away the child until she obtains a court order to do so.

A.Dear Sir,
In the meanwhile you may file Permanent Child Custody case and get an injunction order in the same case restraining the wife to take away the child permanently until she got any such order from the Hon’ble Court.
