Property share

Hello.

My mother have her father's property and in his will he mentioned equal share to everyone. My and 4 siblings totally 5 of them get equal share. But now 2 of them are no more. At present our debts are too high, so we thought of taking my mom's share in that. Because we don't have a source of income to run a family. My mom is retired and my sister is studying and I had an accident and resigned my job.

Now my mom's brother and his wife is staying in that home and till now they took all the income from that property like rent n all. Due to our present situation we want this partition to happen very quickly and we don't want anyone to oppose for this. I have strong opinion that those who are staying in that home will oppose for partition. But at any cost we need our share. Please guide me how to proceed further.

A.U can ask about it to Ur mother's sister if all are ready to it then easy to u otherwise file partition suit for it
