Sir my father in law is no more he has 3 sons and 1 daughter and he has left a unwilled self acquired property in which my mother in law is staying along with one son and taking rent.
Now my mother in-law wants to make a partition by way of selling the property and divide the sale value into 5 equal share for which the son who is staying along with is unwilling, we have tried to sit and negotiate with him but he wants the entire property to be partitioned into his name.
All the 4 legal heirs are ready take equal share.
Khatha is in the name of my father in law.
Can my mother in-law make declare a will of her equal share.
Please advice.

A.Try for mutual settlement, else file a partition suit.

A.Dear Madam,
You may file a suit for partition and everything will be settled by way of compromise shortly.
