My son married in the month of Dec.2017,his wife stayed with us till Sept.2018.One day she left our house with her parents without any reason,my son tired at his level best to bring her back till Feb.2019,he left our place and file the divorce pettion undre section 13 a(i) on curelty ground in dist.court Gautam Budh Nagar in the month of March 2019.
They never turned up in the court till Nov. 2019,in the month of Feb.2020 their advocate has submitted a stay order granted by Hon.Supreme Court (transfer pettion under section 25) in the court.
Now what can he do as he is having a financial crunch.

A.Dear Sir,
Normally such transfer petition will be allowed and it will be transferred to her place and engage one lawyer and contest the case.

A.1. the divorce case will transfer to the location of the wife,
for your son:
try to settle the matter amicably with your wife involving elders/relatives/friends etc and go for Mutual Consent Divorce which will be decided in 6-18 months, and you both will be free to live life with your wish,
don't forget to draft an MOU before approaching Mutual Divorce, which is the most essential and important part of a Divorce case,
some basic points to keep in mind and put in writing through an MOU before filing the petition for mutual consent divorce are custody of kids, distribution of assets (movable/immovable), quash/withdraw of pending litigation if any, Maintenance (present/future), Alimony, mode and time of making the payment, streedhan, future litigation, etc.
