Hi Lawyers, I stayed in a rent house in Bangalore for last two years paying Rs. 19,000 for first year and second year Rs. 21,000. I vacated the flat and the owner did not refund the Security deposit.


A. You better ask her to explain what that security deposit is for. Once the court fee is paid which is as per the rules then there should not be any requirement of any deposit with the court unless there is specific rule in a state and for that kind of cases.
Please ask her to calrify the heading of this deposit and that should siffice.

A. It is not like who lives where. The issue is if it is a family property i.e. ancestral property then all heirs will have equal share in such properties. If it is self acquired, then only the owners have right in that property. As regards your bro.in law, if the property is acquired by your mother in law and your father in law, then he (bro.in law) will have right to share in that property in future, unless it is disposed of by them during their life time.
