Hi Lawyers,
I stayed in a rent house in Bangalore for last two years paying Rs. 19,000 for first year and second year Rs. 21,000. I vacated the flat and the owner did not refund the Security deposit. The security deposit was Rs.1,50,000.
The owner stays in Mumbai.

So, I hired a Lawyer and sent a legal notice. The Legal notice was not received by the owner and was sent back.

So, the lawyer said, we have to go to court to get the security deposit back. First, she told, Lawyer’s fees is Rs. 10,000 and Court expenses is Rs. 4,000. I agreed to this.

After few days, I called the lawyer and she told me that, I should i first deposit Rs. 10,000 (10% of the Rental Agreement Value) and Rs. 10,000 as Lawyer fees, Rs.4000 as court fees.

Lawyer's Fees - Rs. 10,000 - to be paid - Mandatory
Court expenses for filing - Rs.4000 - Mandatory
Value of the Security Deposit - Rs.1,50,000 - To be deposited with Court - Rs. 10,000, Is this Mandatory?

Is this correct? I feel the Fees is very high. I have not received any amount and still have to pay for all this.

How can i find another Lawyer, who charges lesser fees and also accepts part payment in Bangalore.

Please suggest on this.

A.You better ask her to explain what that security deposit is for. Once the court fee is paid which is as per the rules then there should not be any requirement of any deposit with the court unless there is specific rule in a state and for that kind of cases.
Please ask her to calrify the heading of this deposit and that should siffice.

A.Hello,

10000/- is the nominal fees for a reputed lawyer at Bangalore. Regarding court fees you need to pay the same.

A.Court fees as per fixed schedule. Advocate's fees (depends on each professional) and miscellaneous expenses will be extra. Suit would be filed by litigant through legal professional (if required) of his choice, for legal and professional assistance during legal proceeding. If you wish to file suit by yourself as a party-in-person then do so. Else, discuss with your lawyer and file suit.

A.Dear Sir,
You must have faith on lawyers and doctors. Any all law suits are attached with some prestige issue and social responsibility. The high the profile of the advocate the rate of fee will be high. In Bengaluru office and stationary charges are more than court fee also.
