You will have to file a petition to the family Court under Section13B of the Hind Marriage Act, if you are Hindus.

A.If you are residing separately for more than one year continuously and not able to cohabit and decided to part ways mutually just work out your consent terms and file for mutual divorce in d Family or District Court as the case may be. Good Lawyer including us can assist you if need be. It may take anywhere between 6 to 8 months after filing to get the Decree. If anything urgent or reasonable cool off period of 6 months can be asked to be waived off and in such cases Decree can be obtained earlier too. However these are rare exceptions and not a matter of routine. Regards

A.You have not stated your matter in details however you can file mutual consent divorce with the help of a lawyer in Family Court in case you and husband both have made up your mind and all the terms and conditions have been met between you both.
