A. Since you have not mentioned which state that property is located so the rent control act or premises tenancy act of which state would be applicable is not clear. Nevertheless what is also important is to find out if the property has been rented on lease or license. What would also matter is if the rent will be guided within the periphery of the tenancy act or transfer of property act.

A. Hi,
It is to add to your knowledge that If the transfer deed has not been executed yet, the property is your mother's only.
On her own desire, your mother can cancel the transfer deed and pay the loan on her own.

A. Since there is a civil suit they cannot sell the property , moreover if you are able to prove the WILL then the property will belong to the persons as mentioned in the will or else the property will be divided among all the children of your grand mother.

A. You will have to get copy of No Objection certificate of your brother who is alive and copy of death certificate of the brother who is deceased and present the same before the landlord and ask him to get house in your same as tenant.
