Hi I want to know whether it's possible to file a domestic violence case post divorce? I left my husband last month due to physical abuse and I want to take back my gold and other investments which are there with his family. I want to legal action against him however everyone is saying it is not practical bcz of time, money and other constraints. I want to know if I can file divorce by mutual consent and then file a case for domestic violence?
A.In mutual divorce there will be clause saying you can not proceed against you any further and vice versa.

A.First of all you will need to file domestic violance case against them immediately .

A.You can file a domestic violence case later on but understand that when you get divorce under MCD then it is assumed that all went well between you. So, after MCD if you try to file a domestic violence case then your husband or his lawyer will twist the case in his benefit that you are untrue as we settled things nicely and amicably.
Now if you have good evidences or proof against him of perpetrating violence on you then you will have a strong case. Just like that if you file a case post MCD it will not have that strength.
