If i file contested divorce can my wife claim maintenance if she does not respond to divorce petition and does not appear in hearing?
Although i am jobless due to lockdown .

Whether you employed or not at least minimum of rupees 5000 may be asked to pay to your wife as maintenance. If she did not appeared then you will get ex-parte divorce decree.

A.Yes she can claim for maintenance but as u mentioned in ur statement tgat u have lost ur job during lockdown in thay case u have to prove that u don't have job.

Maintenance order depends upon many aspects where quantum,period of maintenance calculated and also there are circumstances where maintenance sanctioned can be cancelled and also divorce can be happen without maintenance etc.

A.Yes , she can claim even you are job less because you are healthy and liable to maintain her .
But a lady when she is unable to maintain herself, then only she can claim maintenance from husband .
You can highlight her properties, educational qualifications and past job history or present able to do job .
