Dear All
Hope you are safe and well
I have a situation where I would need your Legal expertise
My mother has a flat in Mumbai (Andheri East) on her name, purchased in year 2000 from a Pvt Company.
At the time of purchase my mother did pay the stamp duty, but she did not registered the sale deed as she was not aware of the importance as well as the procedure of the registration.
However, we have the sales deed and stamp duty proof with us, along with proof of all the agreements (changed of ownership) of this flat since it was built.
I would like to understand is that possible to register the year 2000 sale now ? as we are planning to sell this apartment.

A.stamp duty was paid but registration was not done for procedure of the registration ?
Mumbai (Andheri East) flat is now crores.
you need seller private company also to do registration which can not happen now.
there are ways to do it by local lawyer

A.Dear Sir,
You have to check with local Sub-Registrar office but as my knowledge it cannot be registered. However you can file a suit for declaration and get a direction for registering the property or alternatively declaring the property as that of your own property.

A.Hi,
Yes, you have to register your property as you will be unable to sell it otherwise.
You shall need an encumbrance certificate from the old owners and then submit it along with all relevant documents to the sub-registrar's office.
