Dear Sir/Madam, In our village there is a Wakf institution of dargah, masjid and graveyard and also it is registered with the Wakf Board. And there is a seperate service inam land for the purpose of maintanence/services/etc to this wakf institution. We were claimed for succession for both institution and inam under Hyderabad Atiyat inquiries Act 1952! But The Deputy Collector (Atiyat) grants succession for inam land but rejected to grant the succession for wakf institution for not having an inam. So should we have file to an appeal against the order of rejection? Or do we really need it? So kindly please help/explain me.

A.Hi,
The first thing you shall need to do is appoint an imam under the rules prescribed by the Wakf Act. If too much time has passed since the last imam was appointed, then you shall need to file an application for condonation of delay to the relevant authority, this would depend on the duration of time that has passed. Once this is done, the Deputy Collector will have no reason to reject your application for succession of the wakf institution. You have to file an appeal within 60 days of the order passed by the Deputy Collector accompanied by a duly filled Form A (under Rule 3) of the Hyderabad Atiyat Inquiries Act.

A.Hi,
