We have purchased a land in 1984 in Delhi and still living in it. Power of attorney is in my father's name. My paternal uncle with his family are living with us. At the time of purchase of land, my paternal uncle and aunt were living with my father and mother on rent. When we told them to leave the house as i and my sister grown up, they refused to go. They are demanding half portion of house by stating the reason that uncle was giving a portion of salary to my father before purchase of land as he was living with my father and mother. They had not spent a single penny in construction and re-construction of house. We have not charged any rent from them. We have earlier charged nominal fixed amount for electricity and water from them and now as per electricity meter reading plus some amount for water. Now, how can we vacate our home from them. Please help.

A.Dear Sir,
You may get file a dummy suit for declaration and thus get title to the property and then file a suit for eviction.

A.36 years is lot of time.
no rent agreement was made.
no document to prove that they were on rent.
they have their all proofs of this address as home for very long.
if you can collect evidence then you can win.

A.Hi,
Send them legal notice informing them that they must vacate within the allotted timeframe. If they do not comply, you can get a Court order for eviction, and then they can be forced out by the police.
