I want divorce and compensation for mental harassment. We married under SMA (it was Love marriage on Feb 16, 2020, 9 year of relation since 2012). We bought a joint property. Later I got to know about my wifes plan. My wife not ready for mutual divorce although she is secretly planning to marry a US citizen and I have evidences for that. My wife discreminates me on basis of caste and abuse my entire family. She threatens me of false charges and mentioned to go to extent possible to destroy me because she belongs to baristers family. She has asked me to commit suicide if I cannot tolerate all these and blatantly spill lies physically harras.

A.If you have proper evidence and confident enough to prove it, then you can file divorce on the ground of Adultery and can claim compensation for mental harassment

A.Hi,
A case for divorce may be filed under section-13(1) of the Hindu Marriage Act, 1955 stating mental cruelty as a ground for divorce.

A.Hi,
You may file a case for divorce under section-13(1) of the Hindu Marriage Act, 1955 stating mental cruelty as a ground for divorce.
