My mothers father (maternal grandfather) was living in wada on rent in pune (maharashtra). My moms father had 8 children. He later on got flat from his builder but his son has put his name on agreement & My mama (mothers brother) has now sold the flat & my mom got recently operated for hip bone surgery. My mom is pressurised from his brother not to ask for share. When i asked my mom she refussed to speak on this issue with me. So as a son can i claim this share. What legal righrs i have to claim my nanas property on my moms behalf. I want some lawyer from pune who can advice on this.

A.If the property was in name of your Nana then it would have been easier, however in your case the property is in name of your mama, so it might be difficult to prove that property was purchased by your Nana money and it was a joint property. If this can be proved and you have sufficient evidence to prove, you may contact a local lawyer of your area who is expert in property law and then consult and discuss to file a case to get your share.

A.Hi,

Your mother has an equal right over your grandfather's property as per the Hindu Succession Act, 2005. However, only she can file the partition suit. In order to file it on your mother's behalf, you need to take SPA from her.

A.Hi,

As per the Hindu Succession Act, 2005, your mother has an equal right over the property of your grandfather.
She will have to file the partition suit herself. However, you can take SPA from your mother and then file a suit on her behalf.
