Father(husband) brought a piece of land on mother name(wife)...who can claim first after the mother's(wife) death, without a will....?? Father(husband) or son?....

A.Dear Client,

Without a will, after a mother's death, her property will fall to the father and children, each with an equal share, and both father and the child are entitled to claim the property through a Legal Heir Declaration.

A.After mother's death without making and publishing any Will, her property will devolve upon father and son( and daughter,if any),each having equal share therein so both father and son are entitled to claim the property through Legal Heir Declaration..

A.Depending on the local laws, state laws and which school of hindu law (dayabhaga or mitakshara) you belong to the property will be divided between all the legal heirs of your mother. That includes you and your father.
