Married on 28 april 2018 .My husband filed divorce on 2019 Oct in Ambala . we did not went to court nor took summon as I am working outside india in same city as my husband . He is also doing job here but not letting me live with him nor in laws letting me live with them . My jewellery n other things are in sasural WITH inlaws. I dont want divorce . Court case still going on till date . My husband saying to give affidavit to him saying what mistake I did and then he will take the court case back and take me back again .
Should I sign the affidavit from here from embassy ? what risk it has if I admit my mistake and give him affidavit .He applied court case on basis of mental cruelity . He has prood of recording of me talking with my mother about his family saying bad things and once I give him laung cloves in food because pandit said it will bring love in our marriage . No children in marriage .He still talks with me .I dont want any money or anything from him .I just want my jewellery if there is divorce. how much time ex parte divorce takes place in how many years? Should I sign the affidavit to admit my mistake and give to him ?

A.Dear Client
You signing the affidavit and accepting every allegation will put you in weaker footing for the case and might have repercussions in future. You should not sign the affidavit instead you should negotiate your husband for mutual consent divorce without any allegations on each other.

A.Dear Client,
The time limit to set aside the ex parte divorce decree by the same court which passed the decree is 30 days and if you are going for an appeal, then it is 90 days to file an appeal against the decree. You can still appeal in the high court against the decree by filing condone delay petition along with the appeal.
