Property related - My in laws have a SRA flat
2 years ago
My in laws have a SRA flat. Both passed away without any will or nominations. They have 3 children. The society is telling they cannot transfer it on their name, only SRA dept can do it. And also it can be only on one name. So one child wants it in her name alone. Can she do it or not? Pls advice.
A.Dear Client,
You can get a transfer in all the heirs name jointly. For transferring immovable property you shall have to obtain a legal heirship certificate from the Tahsildar. After obtaining a legal heirship certificate you may apply for transfer of all the records.

A.Dear Sir,
It cannot be transferred in a name of single child unless other children execute relinquishment deed. Or settle the issue by way of registered settlement deed.
